Zooarchaeological evidence has often been called on to help researchers determine prehistoric relative abundances of elk (Cervus elaphus) in the Greater Yellowstone ecosystem. Some interpret that evidence as indicating elk were abundant; others interpret it as indicating elk were rare. Wildlife biologist Charles Kay argues that prehistoric faunal remains recovered from archaeological sites support his contention that aboriginal hunters depleted elk populations throughout the Intermountain West, including the Yellowstone area. To support his contention Kay cites differences between modern (...) and prehistoric relative abundances of artiodactyls, age and sex demographics of ungulates in the prehistoric record indicating selective predation of prime-age females, and a high degree of fragmentation of artiodactyl bones indicating humans were under nutritional stress. Kay’s data on taxonomic abundances are time and space averaged and thus mask much variation in elk abundances. When these data are not lumped they suggest that elk were at some times, in some places, as abundant as they are today. Data on the age-sex demography of artiodactyl prey are ambiguous or contradict Kay’s predictions. Bone fragmentation data are variously nonexistent or ambiguous. The zooarchaeological implications of Kay’s aboriginal overkill hypothesis have not yet undergone rigorous testing. (shrink)

Despite numerous laws and religious tracts prohibiting homosexuality and the practise of same-sex activity in colonial North America, very few people were ever brought to trial – and even fewer found guilty – for engaging in such “unseemly practises.” Using both primary and secondary sources, this paper attempts to dissect the reasoning behind the relative lack of prosecutions of men thought to have participated in “sodomitical [sic] behaviour”. By comparison with the Atlantic Ocean, the physical oceanography of the Pacific was poorly known as late as the end of the 1930s. International collaboration to study the Pacific, attempted by oceanography committees of the Pacific Science Association, was a failure, owing to the scale of the enterprise, the low scientific abilities of the Pacific nations, and the lack of a compelling need. Even in the U.S.A., where the Scripps Institution of Oceanography was active, lack of good ships and personnel (...) reduced the effectiveness of Pacific oceanography. Scripps's physical oceanographer George F. McEwen was more physicist than physical oceanographer; he also became side-tracked into climatology. Only with the arrival of H. U. Sverdrup at Scripps in 1936 did Pacific physical oceanography begin to prosper, but its greatest success followed World War II, when techniques and approaches transplanted from the Atlantic became established. Comparative political theory is at best an embryonic and marginalized endeavor. As practiced in most Western universities, the study of political theory generally involves a rehearsal of the canon of Western political thought from Plato to Marx. Only rarely are practitioners of political thought willing (and professionally encouraged) to transgress the canon and thereby the cultural boundaries of North America and Europe in the direction of genuine comparative investigation. Border Crossings presents an effort to remedy this situation, fully (...) launching a new era in political theory. Thirteen scholars from around the world examine the various political traditions of West, South, and East Asia and engage in a reflective cross-cultural discussion that belies the assumptions of an Asian "essence" and of an unbridgeable gulf between West and non-West. This essay undertakes a critical deconstruction of the core axiomatic principle of the North Korean Juche ideology: “Man is the master of everything and decides everything.” The author examines the axiom as an epistemic construction that structures human perception of objective reality, identifying fundamental philosophical problems in its binary opposition of “man” and “everything.” Despite official North Korean claims that Juche is an “original revolutionary philosophy” and a “man-centered philosophy,” critical analysis reveals that the axiom is nonsensical, that (...) it has no genuine or real philosophical content, and that the Juche ideology is neither humanist nor materialist nor rationalist. Aesthetics is not a subject usually associated with North Korea in Western scholarship, the usual tropes being autocracy, counterfeiting, drugs, human-rights abuse, famine, nuclear weapons, party-military dictatorship, Stalinism, and totalitarianism. Where the arts are concerned, they are typically seen as crude political propaganda. The recent confirmation of the constitutionality of the Obama administration’s Patient Protection and Affordable Care Act (PPACA) by the US Supreme Court has brought to the fore long-standing debates over individual liberty and religious freedom. Advocates of personal liberty are often critical, particularly in the USA, of public health measures which they deem to be overly restrictive of personal choice. In addition to the alleged restrictions of individual freedom of choice when it comes to the question of whether or not (...) to purchase health insurance, opponents to the PPACA also argue that certain requirements of the Act violate the right to freedom of conscience by mandating support for services deemed immoral by religious groups. These issues continue the long running debate surrounding the demands of religious groups for special consideration in the realm of health care provision. In this paper I examine the requirements of the PPACA, and the impacts that religious, and other ideological, exemptions can have on public health, and argue that the exemptions provided for by the PPACA do not in fact impose unreasonable restrictions on religious freedom, but rather concede too much and in so doing endanger public health and some important individual liberties. This article analyses the drama surrounding the activism of female imams in North America. The image of Muslim women presiding over mixed congregational prayers evokes dramatically divergent responses among different Muslim constituencies, highlighting the disputed nature of fundamental issues pertaining to identity, community and authority. Provocative questions are raised: Can Islamic texts and communities of interpreters accommodate female religious authorities? Is it in the interest of Muslim women to seek empowerment within a domain of communal life in which (...) male authority has traditionally been dominant in all Sunni and most Shi'ite denominations? Do efforts to advance women within such contexts promise to help bridge the gap between ‘Islam’ and the ‘West’, or merely underscore existing divisions and political motivations? In particular we explore two prominent figures, Amina Wadud and Asra Nomani, and each woman's understanding of basic textual debates, conception of Muslim women's needs, and perspective on themes pertaining to ‘Islamic—North American’ relations. Throughout this article, an attempt will also be made to clarify a central paradox of the North American imamah phenomenon: that it is both a highly contingent response to specific cultural and political circumstances and a manifestation of long-term negotiations within the larger Muslim community that favour the opening of new spaces for women within religious and social life. Suzuki’s Legacies and an “Academic Dharma Lineage” in North AmericaMichiko YusaProfessor Abe is generally regarded as the torch bearer of D. T. Suzuki. But how did that come about? This essay sheds light on the relationship between Suzuki and Abe.Abe’s professor, Hisamatsu Shin’ichi, had come to know Suzuki through his mentor Nishida Kitarō. Suzuki was one of Nishida’s closest friends. It appears that Hisamatsu’s (...) and Suzuki’s cordial relationship became closer after Nishida’s death in 1945. Hisamatsu in turn was the link for Abe to come to know Suzuki. Abe recalls his first encounter with Suzuki, which took place in the winter of 1947, when Suzuki was in bed with a bad cold and Abe was sent by Hisamatsu to make a sick call on his behalf. Abe was then Hisamatsu’s teaching assistant ( joshu). Seeing Suzuki in person for the first time, Abe could not help but feel the unique spiritual presence of this man. At that time, Abe, though a committed follower of Pure Land Buddhism, was deeply troubled with his spiritual quest. Perhaps sensing Abe’s agony, Suzuki gave him a copy of his imperial lecture The Essence of Buddhism, in which he had treated Zen and Pure Land thought as sharing the same Mahayana roots.1Abe’s second visit to Suzuki came in the spring of 1949, when Suzuki was preparing to leave for the United States to spend “the rest of his life in order to bring the message of Zen Buddhism” to the West. At that time Abe was to convey Hisamatsu’s concern that Suzuki ought to remain in Japan and contribute to internationalizing Zen by translating Zen texts into English, for, in Hisamatsu’s mind, there was no one better qualified than Suzuki to carry out that task.2Suzuki was ready to make a bold move, however. Having witnessed Hiroshima-Nagasaki, he was convinced that the message of wisdom and compassion based on the awakening to the “true self” that Zen speaks of was an effective and necessary antidote to the egocentric mindset, which manifested also as national ego-centrism, rampant in the post–World War II world. He was convinced that the message of awakening and compassion would give the humanity a better chance at peace. In fact, by the early 1950s, with the intensification of the Cold War and the turmoil in Korea, there was a palpable fear that World War III might break out any day, and Suzuki certainly shared that ominous sense.3 [End Page 111]Zen Must Adopt New ExpressionsSuzuki left for the United States on June 16, 1949, to attend the Second East-West Philosopher’s Conference and to teach at the University of Hawai‘i in the summer and the fall semesters. Through his interaction with Western and Asian thinkers at the conference as well as with his students at the university, he came to feel strongly that (1) it was important to emphasize compassion (hi) in the face of an excessive Zen emphasis on the koan practice, (2) Zen Buddhists must develop their “logical” expression to articulate Zen teaching in language understandable to Westerners, and, in this connection, (3) it was incumbent on him to introduce the thought of Nishida Kitarō to the West. In Suzuki’s own words, “Contemporary Zen is short of compassion (hi). Therefore, it lacks the momentum to engage society and work from within it. Again, it lacks a logical discourse (riron). This is something Nishida always used to say. In order to make Western thinkers understand Zen teaching, one must have a logical system (ronri).” 4These three points are clearly present and developed in Abe’s works. On November 18, 1994, academic, activist, and philosopher Cornel West addressed the National Alliance of Black School Educators at a conference in the Westin Bonaventure Hotel in Los Angeles, California. Dr. West’s speech, captured in this video recording, focuses on the experience of African Americans in America, a culture that, according to West, is steeped in the “pernicious and vicious” influence of white supremacy. West argues that 1994 is one of the “more frightening and terrifying (...) moments” in the history of the United States, and he laments the election of Newt Gingrich as well as the leadership positions of such figures as Strom Thurmond and Orrin Hatch. He urges the audience to adopt an approach to democratizing American politics by not only resisting white supremacy but also male supremacy, heterosexual supremacy, and any other attitude that dehumanizes other people. West also deplores the decline of “non-market values” such as kindness, community, and love, contending that “market culture” leads to “market morality,” in which every part of human life is commodified. In the United States and Europe, an increasing emphasis on equality has pitted rights claims against each other, raising profound philosophical, moral, legal, and political questions about the meaning and reach of religious liberty. Nowhere has this conflict been more salient than in the debate between claims of religious freedom, on one hand, and equal rights claims made on the behalf of members of the lesbian, gay, bisexual, and transgender community, on the other. As new rights for LGBT individuals have (...) expanded in liberal democracies across the West, longstanding rights of religious freedom -- such as the rights of religious communities to adhere to their fundamental teachings, including protecting the rights of conscience; the rights of parents to impart their religious beliefs to their children; and the liberty to advance religiously-based moral arguments as a rationale for laws -- have suffered a corresponding decline. Timothy Samuel Shah, Thomas F. It is widely believed that there is more freedom of speech in America today than there was at the time of the founding. Indeed, this view is shared by liberal commentators, as one would expect, as well as by leading conservatives, which is more surprising. “The body of law presently defining First Amendment liberties,” writes liberal law professor Archibald Cox, grew out of a “continual expansion of individual freedom of expression.” Conservative constitutional scholar Walter Berns agrees: “Legally we enjoy (...) a greater liberty [of speech] than ever before in our history.” This shared assessment is correct—from the point of view of the political theory of today's liberalism—but it is incorrect from the point of view of the political theory of the American founding. I differentiate the question of the value of knowledge (Part 1), and its content (Part 2). The purpose of the article is to reveal philosophical ideas in the mythology and folklore of the indigenous peoples of North America. An important question: "Can we assume that the spiritual culture of the American Indians contained philosophical knowledge?" remains relevant today. For example, European philosophy is defined by appeals to philosophers of the past, their texts. The philosophical tradition is characterized by rational argumentation and formulation of philosophical questions that differ from the questions of ordinary language. However, (...) the problem lies in the term "philosophy", which belongs to the so-called "philosophical untranslatability" and has many definitions. The question of whether philosophy is exclusively a phenomenon of European culture is still controversial. In the article, the concept of philosophy is used in a broad sense, which allows the analysis of the intellectual heritage of the culture of the indigenous people of North America for philosophical ideas. Theoretical basis of the study consists of primary sources, which are limited due to the "documentary horizon". It contains myths about the Twins, ritual rhetoric, examples of dream interpretation practices and the practical wisdom of tribal chiefs. The Chronicle of "Vallamolum", or "the Red List", testifies to the special idea of the Indians about history and their own historicity. Analysis of cosmogonical and cosmological ideas reveals the special features of the anthropological ideas of the North American Indians. Combined with the philosophical ideas of the Puritan philosophy of the settlers of New England, this analysis allows us to explore in more detail the processes of acculturation. The study uses critical literature from scholars and leading researchers of the wisdom and philosophy of Native Americans, such as Michael Yellow Bird, J. Baird Callicott, Henry Wadsworth Longfellow, Dennis H. McPherson, Lewis Henri Morgan, Thomas M. Norton-Smith, J. Douglas Rabb, Paul Radin, Jon Ewbank Manchip White. The views of early American philosophers: R. Williams, W. Penn, R. W. Emerson, on the problem of the relationship between the culture of settlers and the indigenous people of North America are noteworthy. Originality lies in the application of historical and philosophical methodology, identifying the features of philosophizing in the spiritual culture and worldview of the indigenous people of North America. Conclusions. In the conclusions, the obtained results complement the history of the origin and development of philosophical thought of the early American philosophy. (shrink)

Most documented extinctions of vertebrates in the last 400 years have been island endemics. In this paper, we focus on the need to develop a historical framework to establish conservation priorities for insular faunas and, in particular, to test the validity of nominal endemics. We use the example of the islands of the North Pacific Coast of North America, a region that includes approximately one-half of all mammals endemic to North American islands north of Mexico. (...) Few of these endemics have been re-evaluated since their original descriptions, although many of these islands have been heavily impacted by habitat conversion, species introductions, over-exploitation, and secondary ripple effects. Evidence from molecular genetics and paleontology suggests that many taxa arrived in the region since the last glacial advance. Some of these nominal endemics show minimal differentiation, while others comprise multiple evolutionary lineages. The NPC may also have played an important role in the in situ diversification of some taxa during the Pleistocene. Evidence, such as new fossil discoveries and numerous described endemics, lends support for refugia hypotheses. However, these ideas cannot be tested until a better understanding of geographic variation and the evolutionary relationships of the fauna and flora of the North Pacific Coast is developed. Native food production in the Eastern Woodlands of North America before, and at the time of, European contact has been described by several writers as “slash-and-burn agriculture,” “shifting cultivation,” and even “swidden.” Select quotes from various early explorers, such as John Smith of Pocahontas fame, have been used out of context to support this position. Solid archaeological evidence of such practices is next to non-existent, as are ethnographic parallels from the region. In reality, the best data are documentary. (...) Unlike previous assessments, this paper evaluates sixteenth and seventeenth century ethnohistorical references to anything that can be even remotely construed as supportive of previous claims. Analyzed as a group these sources reveal something completely different from what common knowledge would have us believe. References to the slashing, the burning, and the shifting of fields are reasonably abundant. Rarely, however, are all three activities mentioned in a single passage, or by one chronicler. Furthermore, subtleties often overlooked in these quotes reveal great insight into native practices. This paper assesses explorers' and early settlers' descriptions in the context of the larger body of literature dealing with the ecology of swidden agriculture today. Indigenous fields in the Eastern Woodlands tended to be large, numerous, contiguous, and cleared of roots and stumps. Fields previously cleared of trees were covered with grass prior to preparation for planting. They were permanently cultivated. This condition stands in marked contrast to present-day swidden fields in other parts of the world that tend to be small, few, scattered, partially cleared of trees, and cultivated for only a year or two before being abandoned. Slash-and-burn shifting cultivation became common only after European settlers introduced steel axes. It was then practiced on uplands, not the formerly cultivated floodplains that were usurped by interlopers. (shrink)

Prior to European influence, predation by Native Americans was the major factor limiting the numbers and distribution of ungulates in the Intermountain West. This hypothesis is based on analyses of (1) the efficiency of Native American predation, including cooperative hunting, use of dogs, food storage, use of nonungulate foods, and hunting methods; (2) optimal-foraging studies; (3) tribal territory boundary zones as prey reservoirs; (4) species ratios, and sex and age of aboriginal ungulate kills; (5) impact of European diseases (...) on aboriginal populations; and (6) synergism between aboriginal and carnivore predation. Native Americans had no effective conservation practices, and the manner in which they harvested ungulates was the exact opposite of any predicted conservation strategy. Native Americans acted in ways that maximized their individual fitness regardless of the impact on the environment. For humans, conservation is seldom an evolutionarily stable strategy. By limiting ungulate numbers and purposefully modifying the vegetation with fire, Native Americans structured entire plant and animal communities. Because ecosystems with native peoples are entirely different than those lacking aboriginal populations, a “hands-off” or “natural regulation” approach by today’s land managers will not duplicate the ecological conditions under which those ecosystems developed. The modern concept of wilderness as areas without human influence is a myth. North America was not a “wilderness” waiting to be discovered, instead it was home to tens of millions of aboriginal peoples before European-introduced diseases decimated their numbers. (shrink)

Consecutive waves of paleolithic migrants crossing the Bering land bridge from Siberia to North America between 80,000 and 7,000 b.c. brought with them the shamanic way of harnessing supernatural powers. This way prevailed until the White intrusion 400 years ago, into the living space of the aboriginal peoples of North America. Wherever European political, religious, and economic dominance was established, shamanic institutions became the focus of negative attention. The shamanic practitioner was variously depicted by governmental and (...) ecclesiastic authorities as a charlatan and imposter or a purveyor of evil influence. Some well-known ethnological and medico-psychological experts have until very recently portrayed the shaman as a mentally deranged person whose “primitive” culture permits the acting-out of psychopathology in a prestigious role, a eurocentric and positivistic fallacy rooted in Western misinterpretations of learned behavior manifested during shamanic rituals involving altered states of consciousness. Legal measures to suppress shamanic ceremonials were taken in the United States, especially in the aftermath of the Ghost Dance. This shaman-inspired movement, originating in the Prophet Dance of the Pacific Northwest (Spier 1935), sent waves of hectic sacro-nativistic ceremonial activity through many Amerindian tribes, and finally culminated in the Sioux uprising of 1890 which ended in the tragedy of Wounded Knee (cf. Markov extended the laws of the calculus of probability to trials that were dependent on each other, purely theoretically. In two articles from 1913, which are presented here in English translation, he applied his theory for the first time to empirical material, namely text. After a presentation of Markov's methods, results, and possible inspirations, the introduction investigates the dissemination of his ideas to Western Europe and North (...) class='Hi'>America in detail.
